Acceptable Use Policy

ManagingLife Inc.'s Acceptable Use Policy

This Acceptable Use Policy applies to all ManagingLife’s products and services, including Solace,
software, applications, and application programming interface (collectively “Services”). Capitalized terms not defined herein, have the meaning set out in the EULA located at https://www.managemypainapp.com/eula, as may be updated by us from time to time as provided therein. We may update this Acceptable Use Policy from time to time by posting an updated version on our website and/or the Services. If there is a conflict between the terms of the EULA and this Acceptable Use Policy, the terms and conditions of this Acceptable Use Policy will prevail with respect to any subject matters covered in this Acceptable Use Policy. If we learn that You have violated this Acceptable Use Policy or are otherwise misusing or abusing Services, we are entitled to restrict, suspend, or terminate Your access to the Services. If You become aware of a violation of this Acceptable Use Policy, including by any Outputs, please notify us immediately at contact@managinglife.com.

In using the Services, You will use the Services in compliance with the EULA and this Acceptable Use
Policy. You must not (and will not attempt to) directly or indirectly to use the Services to engage in,
facilitate, or promote any of the following prohibited activities:

  • access, use, or allow others to access or use Services, Output or Third-Party Products in any matter that would present a risk of death or bodily harm to individuals (including in relation to illegal drugs, weapons, suicide, harm or self-harm) or generate, promote, disseminate, or otherwise use or facilitate content that may harm other individuals, including to encourage self-harm, discrimination, bullying, humiliation, and/or other emotional harms;
  • sub-license, sell, rent, lend, lease or distribute the Services or any intellectual property rights therein, or otherwise make the Services available to any third parties;
  • copy or modify the Services;
  • reverse engineer, de-compile or disassemble the Services or any part of them;
  • access or use the Services or any Output for the purpose of building, or understanding how to build, a similar or competitive software, model, product, or services;
  • remove or obscure any proprietary notices or labels on the Services, including brand, copyright, trademark and patent or patent pending notices;
  • perform any vulnerability, penetration or similar testing of the Services;
  • generate Outputs using inputs or Prompts designed to intentionally infringe the Intellectual Property Rights of any third party;
  • use the Services, ManagingLife Property, Outputs or our third-party providers' property to train any AI or machine learning algorithms or software or create any derivative works, compilations or collective works or in any manner or for any purpose that infringes, misappropriates, or otherwise violates any Intellectual Property Right or other right of any person, or that violates any applicable law;
  • use the Services, Output or Third-Party Products for any reason other than Your personal, family or household use and as permitted in the Agreement;
  • disable, overly burden, impair, or otherwise interfere with servers or networks connected to the Services (e.g., a denial of service attack);
  • attempt to gain unauthorized access to the Services, or bypass any measures we may use to prevent or restrict access to the Services;
  • send, upload, collect, transmit, store, use, post, publish, or otherwise communicate on the Services, Output or otherwise, any data, information, pictures, videos, audio or other materials or content that:
  1. contains any computer viruses, worms, malicious code, or any software intended to damage or alter a computer system or data;
  2. You do not have the lawful right to send, upload, collect, transmit, store, use, post, publish, or otherwise communicate;
  3. is false, inaccurate, intentionally misleading, or impersonates any other person;
  4. gives the impression that it originates from or is endorsed by us or any other person or entity, if that is not the case;
  5. is defamatory, harassing, abusive, threatening, vulgar, exploitative, obscene, harmful, sexually explicit, inflammatory, offensive or discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age or other such legally prohibited ground, or that contains pornography, nudity, or graphic or gratuitous violence, or that promotes violence, racism, discrimination, bigotry, hatred, or physical harm of any kind against any group or individual, or is otherwise objectionable, such determination to be made in ManagingLife’s sole discretion;
  6. is harmful to minors in any way or targeted at minors;
  7. violates, or encourages any conduct that may violate, any applicable laws, infringes, violates or otherwise misappropriates the Intellectual Property Rights or other rights of any third party (including any moral right, privacy right or right of publicity), or would give rise to civil or criminal liability; or
  8. contains information about an identifiable individual other than Yourself;
  • solicit professional advice (including but not limited to medical, health, financial, or legal advice) or content to be used for the purpose of engaging in other regulated activities (including but not limited to political campaigning or lobbying);
  • misrepresent Output as human-generated when it is not;
  • impersonate or attempt to impersonate ManagingLife, a ManagingLife employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing);
  • encourage any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm ManagingLife or users of the Services or expose them to liability;
  • promote any illegal activity or advocate, promote, or assist any unlawful act;
  • publish, market, advertise or in any way distribute the content; or
  • mirror or frame the Services or any content, place pop-up windows over its pages, or otherwise affect the display of its pages.
